Former President Trump Asks High Court Approval for Military Reserve Personnel in the State of Illinois

On the end of the week, the administration submitted an urgent appeal to the US supreme court, seeking authorization to station national guard troops to Chicago and surrounding areas.

This action is part of a broader campaign to increase the domestic use of the military in several cities run by Democrats.

Judicial Challenge Over Troop Deployment

In an immediate request, the US Department of Justice urged the court to overturn a lower court ruling that had stopped the sending of hundreds of state guard members to the Chicago area.

The federal judge had voiced concerns about the White House's reasoning for deploying forces, doubting its reasoning in considering the situation on the ground.

A appellate court affirmed the initial ruling on Thursday, maintaining the stationing on hold while the judicial dispute proceeds.

Government's Claims

The top government lawyer, representing the government, wrote in the latest petition that government officers have repeatedly been “intimidated and assaulted” in the city of Chicago and the neighboring town of Broadview community.

This area is home to an ICE holding center.

The former president has previously deployed military reserve personnel to the Windy City and the city of Portland, following previous sendings to Los Angeles, Memphis, and Washington, District of Columbia.

The White House has claimed that armed forces involvement is needed to control demonstrations and bolster deportation efforts.

Political Resistance

Democratic officials have vehemently criticized the move, arguing that the White House's statements are greatly exaggerated and driven by politics.

They allege the president of exploiting his authority to punish opponents.

Judges have also raised questions about the administration’s depiction of the situation.

City officials say that demonstrations over immigration enforcement have been primarily modest and calm, contradicting the former president's characterization of “combat area” conditions.

Statutory Grounds

At the heart of the legal battle is the administration's application of a federal statute permitting the president to take control of the national guard only in situations of rebellion or when “incapable with the standard military to carry out the regulations of the US”.

The White House insists that the personnel are necessary to protect US facilities and officers from activists.

Latest Developments

In recent weeks, the government nationalized 300 members of the Illinois military reserve and directed more Texas national guard forces into the Illinois.

As state authorities condemned the decision, the former president increased his statements, calling on the detention of the mayor of Chicago and the Illinois governor, each a Democrat, alleging them of failing to protect ICE personnel.

State authorities and Chicago together took legal action against the White House to stop the activation.

On the ninth of October, the presiding federal judge, nominated by President Biden, handed down a immediate block preventing the directive.

Regional Events

Meanwhile in the city, at least a dozen people were taken into custody outside the Broadview Ice detention center following serious disputes between Illinois state police and demonstrators.
